HOS 145 - Articles about Americans With Disabilities Act

 

 

Note - Title III is part of the Americans with Disabilities Act. Students often look for a hospitality article that mentions Title III. Title III deals specifically with accessibility for “places of public accommodation (businesses…) and commercial facilities (other businesses)”. So in other words, any hospitality article dealing with the ADA act and accessibility is referring by default to Title III whether it mentions “title III” specifically or not (and very few of them do).   

 

How to locate articles:

 All of the following were done in the “basic search” screen of the Gale Databasedatabases:

 

If you search the Gale Databasedatabases for  “ada and ‘title III’ and restaurants” as a keyword you may only find a few recent articles about the topic. Do the same search as a full text search (click on “entire documents”) and you should get much better results under the magazines tab—but also a lot of results that aren't on topic.

 

A better way to search is just to search “ADA and ‘hospitality industry’” or “ADA and ‘restaurants’” (IE ADA and something related to the hospitality industry).  You can also try substituting “Americans with Disabilities Act” instead of ADA  (The full name of the law is the subject heading—but in the articles people tend to refer to it as ADA).

 

Because the hospitality industry includes much more than restaurants, a way to get a wider variety of articles is to search  “ADA” (or “Americans with Disabilities Act”) by keyword and then in the box marked  limit “by publication subject:”  put in the phrase  “hospitality industry.”  This actually gets the best results. Make sure you put the terms in the correct box.

ADA LEGAL DOCUMENTS

Text of the Americans with Disabilities Act. The ADA prohibits discrimination and ensures equal opportunity for persons with disabilities in employment, State and local government services, public accommodations, commercial facilities, and transportation. It also mandates the establishment of TDD/telephone relay services

ADA Regulation for Title II, as printed in the Federal Register (7/26/91). The Department of Justice's regulation implementing title II, subtitle A, of the ADA which prohibits discrimination on the basis of disability in all services, programs, and activities provided to the public by State and local governments, except public transportation services.

ADA Regulation for Title III, as printed in the Code of Federal Regulations (7/1/94). The Department of Justice's regulation implementing title III of the ADA, which prohibits discrimination on the basis of disability in "places of public accommodation" (businesses and non-profit agencies that serve the public) and "commercial facilities" (other businesses). The regulation includes Appendix A to Part 36 - Standards for Accessible Design establishing minimum standards for ensuring accessibility when designing and constructing a new facility or altering an existing facility.

Title II & III Regulation Amendment Regarding Detectable Warnings, as printed in the Federal Register (11/23/98). This amendment suspends the requirements for detectable warnings at curb ramps, hazardous vehicle areas, and reflecting pools until July 26, 2001.
